03/11/10: High Court Case for Compensation Claim of £14 million

03 November 2010

A case for compensation that is being heard in the High Court has been adjourned until Tuesday. It centres on the claim for future loss of earnings and medical expenses which may total over £14 million for a man, who at this time remains anonymous. His life has been shattered following irreversible left kidney failure and nerve damage that he suffered during the course of an operation to donate his right kidney to his father.

The Judge said liability had been admitted by Portsmouth Hospitals NHS Trust on the basis that the surgeon, who is subject to proceedings before the General Medical Council, was not only negligent but to a degree reckless.

The man suffered catastrophic injuries that required dialysis for a year until his sister donated one of her kidneys to him. His life however has been shortened by ten years and he is said to be devastated by the experience. "The claimant formerly a hard working, highly regarded, family and professional man faces a life filled with considerable uncertainty."

Elizabeth Williams, a Fellow of the Institute of Legal Executives in the clinical negligence department at Wolferstans commented that, "I hope this man receives the compensation award he deserves after the horrifying events he endured"
